The Medicines (Advertising and Monitoring of Advertising) Amendment Regulations 1999, SI No. 267, came into force on 5 April 1999 and completed the implementation of Directive 92/28/EEC Regulation 13 and the Schedule contain a procedure for a review of the Health Minister's preliminary decision on whether an advertisement complies with the Medicines (Advertising) Regulations 1994, as amended ("the Regulations"). The Health Ministers proposed that the review will be undertaken by an Independent Review Panel.
Terms of reference
The function of the Independent Review Panel are:
- To consider written representations from pharmaceutical companies as to the conformity of their advertising and promotional material with the Regulations
- To advise Health Ministers on the conformity of advertising and promotional material with the Regulations before a final decision is made by Health Ministers.
What membership involves
Consider written representations from companies against the preliminary decisions given by the Health Ministers that the advertising or promotional material is in breach of the Regulations.
Advise the Health Ministers on matters relating to the acceptability of published and unpublished advertising and promotional material under the Regulations.
Meetings
Meetings are held at the MHRA, Market Towers, 1 Nine Elms Lane, London SW8 5NQ. The frequency of meetings will initially be flexible according to need.
Role of members
To attend if possible all meetings of the Independent Review Panel on Advertising, scheduled and unscheduled.
To consider, comment and contribute by their individual expertise and judgement as appropriate on agenda items and assist the panel in framing suitable advice to Health Ministers on the acceptability of advertising and promotional material for medicines.
Criteria for appointment
A member of the Panel will be recognised by his/her peers as an eminent member of their profession or calling and have a wide and recent experience of and have shown capacity in at least one of the following activities:
- the practice of human medicine or pharmacy;
- the law, with particular reference to medicines or advertising;
- a lay member having a particular interest in medicines, public health consumer affairs, or advertising.
